Time to file written statement of defence – incorrect citing of provisions of the law.
- Written statements filed out of time and failure to apply for extension of time within the prescribed time.
- Time starts to run against the defendants/applicants from the date of receipt of service by the defendant and not from the date an advocate representing the defendants receives instructions there from.
- Incorrect citing of provisions of the law renders any application incompetent – an applicant must refer to a specific subsection under which an application is preferred.
