Description
Incomplete record of appeal – a record of appeal missing necessary documents – not fatal – leave to file a supplementary record of appeal granted.
An incomplete record of appeal – a record of appeal did not contain necessary documents namely a memorandum of appeal from the District Land and Housing Tribunal to the High Court, some other documents such as the chamber summons and the affidavit which instituted an application before the High Court; and an order of the Court Appeal made pursuant to the appellant’s application for a second bite. It was held that the shortcoming does not render the appeal incompetent, hence the appellant was granted leave to file a supplementary record of appeal (p. 8).
