Discretion – meaning of judicially – extension of time – pregnancy of one counsel for a public authority.
- In exercising discretion the Court is enjoined to act judicially (p. 4).
- Acting judicially is to act for good or sufficient reason (p. 4).
- Application for extension of time filed by a public authority – reason for delay was pregnancy of counsel for the applicant – the reason was rejected because the applicant being a public authority then its functioning cannot be equated with that of the private person. The Court added that the authority has more than one counsel and so it is inconceivable to hear an argument that the health condition of one counsel affected the whole process (5).
