Description

Bill of costs – notice of appeal – power over the records – withdrawn – revival of the jurisdiction – limitation of time – endorsement of a bill of costs.

  • Bill of costs – it was argued that the applicant did not file a bill of costs because of a notice of appeal before the Court of Appeal which had been filed hence the High Court was no longer ceased to have power over the records  – later on the notice of appeal was withdrawn – it was held that time to file the bill of costs started to count after the withdrawal of the notice of appeal after the revival of the jurisdiction of the High Court (p. 4).
  • The bill of costs was not endorsed with the name and address of the advocate who lodged it – it was held that the application is incompetent (pp. 5-6).
