Combining more than one prayer in an application – omnibus application – circumstances where an application will be an omnibus one –
- There is no law which forbids combining more than one prayer in an application – especially in circumstances where the same prayers can be dealt with by the same provision of law.
- Omnibus application – an application containing two prayers, namely, a prayer for extension of time to file an application to set aside an ex parte judgment and decree on the one hand; and a prayer for an extension of time to file a written statement of defence is an omnibus application hence defective.
- Some circumstances where an application will be an omnibus one – where governing provisions of the law are different, where time frames for preferring the applications are different and where considerations to be taken into account in determining the applications are different.
